§ 1 Scope
These Terms & Conditions (hereinafter "Terms") govern the use of the online platform Mittelaltermarkt-Kalender (hereinafter "Platform"), accessible at mittelaltermarkt-kalender.de, including all subpages.
The Platform is operated by (hereinafter "Operator"):

The Platform is aimed at organisers and visitors of medieval markets and events, primarily in the DACH region (Germany, Austria, Switzerland) and worldwide.
By using the Platform — in particular by submitting an event — you agree to these Terms.
§ 2 Description of Services
Mittelaltermarkt-Kalender is a free information portal for aggregating and displaying medieval markets and events. Browsing and viewing events is free of charge and does not require registration.
The Operator provides the Platform as infrastructure but assumes no responsibility for the accuracy or completeness of event information submitted by users and organisers.
There is no entitlement to uninterrupted availability of the Platform or to the publication of a submitted event.
§ 3 General Terms of Use
3.1 The Platform may only be used for lawful purposes. Any use that violates applicable German or European law is prohibited.
3.2 Automated, large-scale retrieval (scraping) or any other systematic extraction of content from the Platform without the express written consent of the Operator is prohibited.
3.3 The Operator reserves the right to block access to the Platform for users who violate these Terms at any time and without prior notice.
§ 4 Submitting Events
4.1 Users may submit events via the public submission form. Registered organisers may additionally submit complete event entries including descriptions and images.
4.2 Submitted events are only made publicly visible after review and approval by the Operator's moderation team. There is no legal entitlement to publication.
4.3 By submitting an event, the user warrants that:
- The submitted information is truthful and relates to a real event.
- No false statements or misleading information are included.
- The user has the right to use all submitted content (texts, images, other media) on the Platform.
- The submitted content does not infringe any third-party rights, including copyright, trade marks, personality rights, or other intellectual property rights.
- The content does not violate applicable German or European law.
4.4 The Operator reserves the right to reject, edit, or delete submitted events at any time and without giving reasons. This includes events that violate these Terms, are legally problematic, or contain factual errors.
4.5 The submitter is solely responsible for the accuracy, completeness, and legality of the submitted event information.
§ 5 Rights in Submitted Content
5.1 By submitting content (texts, images, other media), the user grants the Operator a non-exclusive, worldwide, perpetual, transferable, and sub-licensable right to store, process, display, distribute, and use the submitted content in the context of Platform operations. This includes in particular:
- Display on the Platform (public event pages, search results, map view);
- Inclusion in the Operator's newsletter;
- Indexing by search engines via structured data (SEO).
5.2 Ownership and all other rights to the submitted content remain with the user. The Operator does not claim any rights beyond those described above.
5.3 The user shall indemnify the Operator against all claims by third parties arising from an alleged or actual infringement of third-party rights through the submitted content. This includes the costs of reasonable legal defence.
§ 6 Liability of the Operator
6.1 The Operator provides no warranty as to the completeness, accuracy, timeliness, or availability of the event information published on the Platform. In particular, the Operator is not liable for cancellations, date changes, or other changes to events submitted by third parties.
6.2 To the extent permitted by law, the Operator's liability for damages of any kind is limited to cases of intent and gross negligence. Liability for slight negligence, loss of profit, indirect damage, or consequential damage is excluded to the extent permitted by mandatory legal provisions.
6.3 The foregoing limitations of liability do not apply to damages resulting from injury to life, body, or health, nor to claims under the German Product Liability Act (Produkthaftungsgesetz).
§ 7 Platform Availability
The Operator endeavours to keep the Platform continuously available but does not guarantee uninterrupted, error-free, or complete availability. Maintenance, technical disruptions, force majeure, or third-party actions may impair availability or cause temporary outages. No claims against the Operator arise from such events.
§ 8 Changes to the Terms
8.1 The Operator reserves the right to amend these Terms at any time. The current version is always available at mittelaltermarkt-kalender.de/en/terms.
8.2 For users without an account (anonymous submissions), the version of the Terms in force at the time of submission applies.
8.3 For users with an account (organisers), material changes will be communicated by email to the registered address. Continued use of the Platform following notification of changes constitutes acceptance of the revised Terms.
§ 9 Governing Law and Jurisdiction
9.1 These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 Where the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is the Operator's registered location in North Rhine-Westphalia, Germany.
9.3 Consumers may bring claims before the courts of their general place of residence. General statutory consumer jurisdiction rules otherwise apply.
§ 10 Final Provisions
10.1 Should any provision of these Terms be wholly or partly invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
10.2 These Terms constitute the entire agreement between the Operator and the user regarding the use of the Platform and supersede all prior agreements on this subject.
